Your membership is subject to our terms of service (TOS).  Please read through the TOS for complete information. Your use of our services implies your acceptance of the current posted TOS.

Membership processing is handled by a billing provider.
(CCBill, iBill, epoch, Verotel)
You should contact directly at customerservice with any membership related problems you may have such as a forgotten password, inability to access our web site, etc.

The membership is on a continuing basis. Your membership will continue until you cancel your subscription. Your credit card will be automatically debited for your membership fees, at the currently posted rates, at the end of each membership period.

New rates can be changed any time. Information about the new pricing will be posted one month before the price change.

YOU AGREE TO THE TOS:

1.
THE CLUB currently provides users with access to a rich collection of resources, including, various communications tools, forums, shopping services, personalized content and branded programming through its network of properties (the "Service"). You also understand and agree that the Service may include advertisements and that these advertisements are necessary for THE CLUB to provide the Service.

Unless explicitly stated otherwise, any new features that augment or enhance the current Service, including the release of new THE CLUB properties, shall be subject to the TOS. You understand and agree that the Service is provided "AS-IS" and that THE CLUB assumes no responsibility for the timeliness, deletion, mis-delivery or failure to store any user communications or personalization settings.

You are responsible for obtaining access to the Service and that access may involve third party fees (such as Internet service provider or airtime charges). You are responsible for those fees, including those fees associated with the display or delivery of advertisements. In addition, you must provide and are responsible for all equipment necessary to access the Service.

2.
You will receive a password and account designation upon completing the Service's registration process. You are responsible for maintaining the confidentiality of the password and account, and are fully responsible for all activities that occur under your password or account. You agree to (a) immediately notify the webmaster of any unauthorized use of your password or account or any other breach of security, and (b) ensure that you exit from your account at the end of each session. THE CLUB cannot and will not be liable for any loss or damage arising from your failure to comply with this section.

3.
I am an adult at least 18 years of age and have the legal right to view, possess and receive sexually explicit material in the location from which I am accessing this site.

If the legal age to view and possess sexually explicit material and images in the location from which I am accessing this site is not 18 years of age, I know what the legal age is in said location, and I am over the legal age in said location to view, possess and receive sexually explicit material.

I am not accessing this site from a location where sexually explicit material is forbidden by law. I understand the laws of the location from which I am accessing this site, and I assume all liability if I violate such laws by entering this site.

I will not redistribute this material (for profit or otherwise) to anyone, including but not limited to minors. I will not share material from this site with any person who is under the applicable legal age to view and possess sexually explicit material, or any adult who might find this material personally offensive.

I am not accessing this site for the purpose of attempting to obtain evidence for the prosecution of any individual or legal entity or for the purposes of entrapment or to use it in any manner against the site operator, list owner, list moderator, list members or anybody else.

By uploading pictures, stories, videos, sounds or any other file to the site you are agreeing that: a. You have the copyright to use the file you are uploading b. You give THE CLUB the permission to alter these files and publish them on yahoogroups, this site and other reproductions on other media including but not limited to internet, databases, CD's, DVDs, video tapes, mobile services.

Members who have subscribed to one or many DATEDICK yahoogroups or are member of this site will receive periodically NEWS directly to their personal mailbox. You can opt-out to not receive these NEWS anymore.

By logging on and subscribing to this service, I release and discharge the providers, owners and creators of this site from any and all liability which might arise.

By attending a CLUB party, you attest that you are of legal age and not a member of any social or religious group, or of any city, state, or federal law enforcement agency, which would not condone CLUB parties. By attending you attest that you are over 21 years of age. CLUB parties provide a fun, safe, and comfortable space for bi men to play. We assume that if you choose to participate you understand and are comfortable with the risks involved. THE CLUB does not promote unsafe sexual practices. Ultimately, your sexual practices are your own responsibility.

10.
YOU EXPRESSLY UNDERSTAND AND AGREE THAT:

a. YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK. THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. THE CLUB EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT.

b. THE CLUB MAKES NO WARRANTY THAT (i) THE SERVICE WILL MEET YOUR REQUIREMENTS, (ii) THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, (iii) THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF THE SERVICE WILL BE ACCURATE OR RELIABLE, (iv) THE QUALITY OF ANY PRODUCTS, SERVICES, INFORMATION, OR OTHER MATERIAL PURCHASED OR OBTAINED BY YOU THROUGH THE SERVICE WILL MEET YOUR EXPECTATIONS, AND (V) ANY ERRORS IN THE SOFTWARE WILL BE CORRECTED.

c. ANY MATERIAL DOWNLOADED OR OTHERWISE OBTAINED THROUGH THE USE OF THE SERVICE IS DONE AT YOUR OWN DISCRETION AND RISK AND THAT YOU WILL BE SOLELY RESPONSIBLE FOR ANY DAMAGE TO YOUR COMPUTER SYSTEM OR LOSS OF DATA THAT RESULTS FROM THE DOWNLOAD OF ANY SUCH MATERIAL.

d. NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED BY YOU FROM THE CLUB OR THROUGH OR FROM THE SERVICE SHALL CREATE ANY WARRANTY NOT EXPRESSLY STATED IN THE TOS.

YOU EXPRESSLY UNDERSTAND AND AGREE THAT THE CLUB SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA OR OTHER INTANGIBLE LOSSES (EVEN IF THE CLUB HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES), RESULTING FROM: (i) THE USE OR THE INABILITY TO USE THE SERVICE; (ii) THE COST OF PROCUREMENT OF SUBSTITUTE GOODS AND SERVICES RESULTING FROM ANY GOODS, DATA, INFORMATION OR SERVICES PURCHASED OR OBTAINED OR MESSAGES RECEIVED OR TRANSACTIONS ENTERED INTO THROUGH OR FROM THE SERVICE; (iii) UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR TRANSMISSIONS OR DATA; (iV) STATEMENTS OR CONDUCT OF ANY THIRD PARTY ON THE SERVICE; OR (v) ANY OTHER MATTER RELATING TO THE SERVICE.

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES OR THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES. ACCORDINGLY, SOME OF THE ABOVE LIMITATIONS OF SECTIONS 11 AND 12 MAY NOT APPLY TO YOU.

DO NOT BECOME A CLUB MEMBER AND DO NOT ATTEND A CLUB PARTY IF YOU CANNOT AGREE TO THESE TERMS OF SERVICES (TOS).
